Re: Request for Information Regarding Clinical Faculty with 5+ Years of Service at UMDNJ on Term Contracts

AAUP-UMDNJ has a concern with the percentage of non-tenured clinical faculty with 5 or more years of service at UMDNJ who have been appointed to one-year contracts (appointment letters).

In addition, AAUP-UMDNJ has a concern that some non-tenured clinical faculty have received reappointment letters that either:

    1. reduces the term of an existing appointment

For example, if you have an appointment letter from July 1, 2004 through June 30, 2008 and you recently received an appointment letter reducing your appointment to July 1, 2007 through June 30, 2008, this gives the appearance that a 5-year appointment is reduced to a 1-year appointment and therefore, reduces the written notice requirement of a non-renewal from 1 year to 4 months.

OR

    2. increases the term of an existing appointment

For example, if you have an appointment letter from July 1, 2005 through June 30, 2008 and you recently received a new appointment letter increasing your appointment from July 1, 2007 to June 30, 2010, this gives the appearance of a 3-year appointment when in reality, it is only a 2-year appointment.

Why is this important ?  The AAUP contract contains a job security provision that requires the University to appoint non-tenured clinical faculty who are at 50% or more FTE with 5 or more years of service at UMDNJ to multi-year contracts as follows:

    1. 75% of all non-tenured clinical faculty who have 5 to 9 years of service at UMDNJ as of June 30, 2007 must be appointed to contracts of 2 years or more following their 5th year of service.
    2. 75% of all non-tenured clinical faculty and who have 10 or more years of service at UMDNJ as of June 30, 2007 must be appointed to contracts of 3 years or more following their 10th year of service.

In addition, the length of your appointment determines the amount of WRITTEN NOTICE the University is required to provide you if your appointment is not renewed.

In order to ascertain whether the University has met its obligation to you, I am requesting that all non-tenured clinical faculty submit the attached confirmation form. In addition, if you have received a reappointment letter during the term of an existing appointment that either reduces or increases the term of your existing appointment, I am requesting that you provide me with copies of your existing appointment letter and the new appointment letter.
